JUSTRIOBA TOURS DEED OF RELEASE AND INDEMNITY

(Please read and be certain you understand the implications of agreeing to be bound bythese terms and conditions.)

JUSTRIOBA TOURS and its partners will take reasonable steps to ensure you are well and safe on the trails and on the trips inside and outside of Kenya.

JustRioba will insure provision of knowledgeable guides, locals, paramedics, support staff and adequate briefing on ways to keep you, the participant, safe on thetrails and on local and international trips.

You as a participant unconditionally confirm that you have been informed of and fully understand all the risks arising out of or connected with trips and hikes including but not limited to: getting lost, severe and/or permanent injury, altitude sickness, attack by wild animals, cold weather and heat related injuries and illnesses, risks associated with river crossings, climbing up and down rocks, all acts of nature including but not limited to thunder and lighting, rock falls and your own negligence.

You understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.

You hereby irrevocably and unconditionally indemnify, release and discharge Just Rioba, Winnie
Rioba trading as “Just Rioba Tours”, its partners, volunteers and employees from any actions, claims, liabilities, demands and set-offs, whether in this jurisdiction or any other, in law or equity, arising out of or connected with any aspects of this trip.

You also agree, on behalf of yourself and on behalf of any of your successors, assigns or estate not to sue, commence, prosecute or cause to be commenced or prosecuted any actions or claims against Just Rioba or its related parties.

You fully understand the effect of the provisions of this deed and voluntarily consent freely and without any coercion and you have been allowed to seek independent legal advice.

This release shall be binding to the fullest extent permitted by law. If any
provision of this release is found to be unenforceable, the remaining terms
shall be enforceable. Any modification to or deletion of a provision or part-provision of this deed shall not affect the validity and enforceability of the rest of the deed.
